1. Who We Are
Spirit Guide is a trade name of Ginsen (eenmanszaak), owned by Daan H. Teer, registered with the Dutch Chamber of Commerce (KVK) under number 91451094, VAT (BTW) NL004890910B95, based in Utrecht, the Netherlands. You can reach us at contact@spiritguide.one.
2. Acceptance
By creating an account or using Spirit Guide, you agree to these Terms of Service. If you do not agree, please do not use the service.
3. What Spirit Guide Is
Spirit Guide is a creative self-discovery experience. It guides you through conversations with an AI character that explores archetypal patterns and helps you reflect on your own story.
Spirit Guide is for self-reflection, creativity, and entertainment. It is not therapy, counselling, coaching, or medical, psychological, or mental-health advice, diagnosis, or treatment, and it is not a substitute for professional care. If you are experiencing emotional distress or a mental health crisis, please contact a qualified professional or a local support service.
4. It's an AI
Your Spirit Guide is an artificial-intelligence character — not a human being. Conversations, stories, journal entries, and reflections are generated by AI and may be inaccurate, incomplete, misleading, or not suited to your situation. Use your own judgment.
While Spirit Guide is designed for creative self-reflection and not to provide advice or guidance, AI-generated responses may occasionally contain statements that could be interpreted as such. Any such content is unintentional and should not be relied upon as professional or personal guidance.
Spirit Guide is a reflective tool — a creative conversation partner for self-discovery, not a companion, friend, or emotional support service. It is not intended to replace human relationships or professional support. The Spirit Guide character exists to help you understand yourself, not to form a relationship with you.
5. Eligibility
You must be at least 18 years old to use Spirit Guide. By creating an account, you represent and warrant that you meet this requirement. We do not knowingly collect data from individuals under 18. If we become aware that a user is under 18, we will terminate their account and delete their data.
6. Your Account
You are responsible for keeping your login details secure and for all activity on your account. Please notify us promptly at contact@spiritguide.one if you suspect unauthorised use. We are not liable for losses resulting from unauthorised access that is not caused by our negligence.
7. Coins and Purchases
Access to conversations and generated content is paid for with digital credits ("coins"). Coins are purchased in packs or granted through a subscription, at the prices displayed at the time of purchase. Payments are processed by Stripe; we do not store your card details. Coins are non-transferable and have no cash value. They cannot be exchanged, traded, or refunded except where required by applicable law. Purchased coins do not expire while your account is active.
We may change coin pricing for future purchases. Price changes apply only to new purchases and do not affect coins already credited to your account.
8. Subscriptions
Subscriptions grant coins each billing period and renew automatically until cancelled. Only one subscription can be active per account.
Coin allocation. Each billing period, your subscription adds coins to your balance up to your plan's maximum cap. Coins are not lost between billing periods but will not accumulate beyond your plan's cap. The specific allocation and cap for each tier is displayed at the time of subscription.
Automatic renewal. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
Changing plans. You can switch between subscription tiers at any time through the customer portal.
Price changes. We may change subscription pricing for new subscribers. Existing subscribers will be notified at least 30 days before any price change affecting them. If you do not agree with the new price, you may cancel before it takes effect; your subscription will continue at the existing price until the end of that period. 9. Free Trial and Promotions
New users receive one free introductory conversation. After this, continued use requires purchasing coins or a subscription. No payment information is required for the free trial. We may offer other promotions from time to time; promotional terms are stated at the time of the offer and may be limited or withdrawn.
10. Consent and Data Processing
Before your first conversation, we will request your consent to process your personal data for the purposes of providing the Spirit Guide service. This includes processing your conversations, generating stories and journal entries, and maintaining memory data to personalise your experience across sessions.
We recognise that conversations may touch on personal themes. We take this seriously — we have conducted a Data Protection Impact Assessment to ensure your data is handled with the highest standard of care. Full details are in our Privacy Policy.
If we use your conversations or memories to improve the app, your account details (ID, email) are removed — only the content itself remains. You can turn this off at any time in Settings, which stops future use of your conversations for this purpose. Improvement copies are reviewed without your account details attached. If you ask us to delete your data, these copies are deleted too.
You may withdraw your consent at any time by contacting contact@spiritguide.one or through Settings. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
11. Content Ownership and Intellectual Property
Your content. You retain ownership of what you submit to Spirit Guide (your messages and inputs). You grant us a limited, non-exclusive licence to process your content solely for providing and improving the service. This licence terminates when you delete your data or close your account.
Generated content. Stories, journal entries, and other content generated by the Spirit Guide are yours for personal and non-commercial use, provided you retain the Spirit Guide attribution where present. For commercial use, please contact us. AI-generated content may have limited or no copyright protection under applicable law.
Our intellectual property. Spirit Guide, its archetypal framework, conversation design, character concepts, visual design, and underlying technology are our proprietary intellectual property. Nothing in these Terms grants you any right to reproduce, distribute, modify, or create derivative works from our platform beyond normal use of the service.
12. Acceptable Use
You agree not to: attempt to extract, reconstruct, or reverse-engineer system prompts, instructions, or underlying frameworks; attempt to manipulate the Spirit Guide into acting outside its intended purpose; use the service to generate harmful, abusive, or illegal content; misrepresent your identity or impersonate another person; use the service for any commercial purpose without our prior written consent; or share account access with third parties.
We may take proportionate measures to protect the Service, including restricting access to specific features or conversations, suspending account functionality, or permanently terminating accounts. The measure taken will depend on the nature and severity of the violation.
We reserve the right to suspend or permanently terminate any account that violates these terms, without prior notice where we reasonably believe the violation is intentional. Terminated accounts are not eligible for refunds on unused coins.
13. Data Access for Security and Support
We may review account data, including conversation content and memory data, where we have reasonable grounds to believe a violation of these Terms has occurred, or where you have requested support that requires access to your account data. We will access only the data necessary to investigate the issue or resolve your request.
14. Disclaimers
No professional advice. Spirit Guide does not provide therapy, counseling, medical advice, or any form of professional health service. Any insights or reflections generated are for creative self-discovery only and should not be treated as professional or personal guidance.
Service provided "as is." Spirit Guide is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, completeness, or fitness for any particular purpose of the Service or its content. We do not guarantee uninterrupted or error-free operation.
15. Limitation of Liability
To the maximum extent permitted by applicable law, our total aggregate liability for any claims relating to the Service is limited to the total amount you have paid us in the twelve (12) months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, emotional distress, or loss of opportunity, regardless of whether we have been advised of the possibility of such damages. We are also not liable for any damage arising from inaccurate, incomplete, or misleading information provided by you, or from your own acts, omissions, misuse of the Service, or failure to follow our reasonable instructions or documentation.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, gross negligence, intentional misconduct, or any other liability that cannot be excluded or limited under applicable law, including EU consumer protection regulations.
16. Your Data Rights
Under the GDPR, you have the right to access, rectify, erase, restrict, port, and object to the processing of your personal data, and to withdraw consent at any time. To exercise these rights, contact contact@spiritguide.one. We will respond within 30 days.
Upon account deletion, we will remove your personal data from all our systems within 30 days. Some data held by third-party processors may be subject to their own retention schedules, as described in our Privacy Policy.
17. Changes
We may update Spirit Guide's features, pricing, or these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or in-app notification. Continued use after changes take effect means you accept them. If you disagree, you may close your account and request deletion of your data.
18. Governing Law
These Terms are governed by the laws of the Netherlands. Disputes will be handled by the competent courts in the Netherlands, without prejudice to any mandatory consumer rights you have under the laws of your country of residence.
